What is a Partner Visa?

The Partner Visa allows you to live in Australia temporarily and permanently. Partner Visas comprise of Offshore and Onshore Visas. If your spouse or partner is an Australian citizen, settled permanent resident, or eligible New Zealand citizen living in Australia, you might be eligible to apply for the Partner Visa. If you lodge a Partner visa whilst in Australia you may get a Bridging visa. You could be limited to work or study during that time. If you had work or study right on your previous visa, the same conditions would continue on the Bridging visa that you get associated with your partner visa. If you meet the criteria you, the first Partner Visa that you get will a Temporary Partner Visa (Subclass 820 or Subclass 309). With this visa, you can live, work and study in Australia temporarily. After holding the temporary visa for 2 years, you will be eligible to apply for a Permanent Partner visa

You might be eligible for a Partner Visa if you:

  • are 18 or older when you apply.
  • are a spouse or partner of an Australian citizen, permanent resident or eligible New Zealand citizen living in Australia for more than a year.
  • do not have any previous visa cancellations and have complied with conditions of your previous visa.

List of Partner Visa

Offshore Partner (Provisional) Visa (Subclass 309) Offshore Partner (Provisional) Visa allows you to live, study and work in Australia temporarily until your permanent Partner Visa decision is made. You must be outside Australia when you apply for the 309 Visa and when a decision is made on the 309 Partner Visa.

Offshore Partner (Permanent) Visa (Subclass 100) Offshore Partner (Migrant) Visa allows you to live, study and work in Australia permanently. You must hold the 309 Visa and continue to be in a ongoing relationship at the time of applying for this visa. You can be onshore when applying for the permanent partner visa

Onshore Partner (Temporary) Visa (Subclass 820) The 820 Visa is an onshore visa that allows you to live in Australia with your husband/wife or your de-facto partner who is an Australian citizen, Australian permanent resident or eligible New Zealand citizen. You must be in Australia when you apply for the 820 Visa.

Onshore Partner (Permanent) Visa (Subclass 801) The 801 Visa allows you to continue living in Australia permanently with your partner if you hold the 820 Visa. Once granted the visa you can live, study and work in Australia permanently. You must be in Australia when you apply for the 801 Visa.

How long does Australian partner visa take?

There are two Offshore Partner Visas available; Subclass 309, the temporary partner visa and subclass 100, the permanent partner visa the average processing time for a decision is 18 to 26 months for the Offshore Partner (Subclass 309) Visa. For the Subclass 100 Visa, the average processing time for a decision is 19 to 26 months.

What is needed for partner visa?

The checklist for a partner visa is below:

  1. Essential Forms – Application form, Form 80, 40SP, 956
  2. Identification Documents – Recent photos, passport, birth certificate or similar, evidence of the sponsor
  3. Relationship History Documents – Registered de facto or marriage certificate, proof of genuine relationship (financial, social, photos etc.), statements of partners
  4. Health and Character Check – Australian national police certificates

What happens after partner visa is granted?

Once the subclass 309 temporary partner visa is granted you will be able to enter Australia. You could also be eligible to apply for the subclass 100 permanent partner visa, depending on the date the visa is granted because you are eligible to apply 2 years after applying for the subclass 309 temporary partner visa. To apply for the subclass 100 permanent partner visa you need to provide additional updated documents to the Department of Home Affairs to prove that you are still in a genuine and continuing relationship.  If you and your partner have been in a long-term relationship or have a child together before the application, is made, you may be eligible to receive the permanent partner visa without the temporary partner visa.

How much does a partner visa cost?

The Department of Home Affair’s charges a total of AUD $7,715 for the subclass 309 and the subclass 100.  The AUD $7,715 is payable at the time of applying regardless of whether you will be granted the temporary along with the permanent or just the temporary as it covers both visas.

Can I sponsor my girlfriend/boyfriend to Australia?

Yes, you can sponsor your girlfriend or boyfriend if you are an Australian citizen, permanent resident or eligible New Zealand citizen, and you are in a de facto, genuine and continuing relationship for at least 12-months otherwise you need to register the relationship.

Can my partner stay in Australia if we get married?

Not necessarily. However, being married or in a de facto relationship to an Australian citizen or permanent resident, or eligible NZ citizen is in the eligibility criteria for a partner visa. If your partner is eligible for a partner visa and eligible to apply in Australia then that will allow your partner to stay in Australia.

How do you prove a de facto relationship?

The proof must contain financial, household, social and commitment documents related to your relationship. You can see some evidence for the de facto relationship:

  • Communication evidence showing genuine de facto commitment to the exclusion of others
  • Sharing of household chores
  • Sharing of financial responsibilities and sharing finances
  • Postal correspondence addressed which shows both of you at the same address
  • Joint mortgage documents and household bills such as electricity, internet, insurance, gas
  • Joint invitations or evidence you go out together, public or commercial bodies about your relationship

Is a partner visa a permanent resident?

Partner Visa has both temporary and permanent residency options depending on the length of the relationship and whether or not you have children together

Can I apply partner visa before marriage?

Yes, you do not need to get married to apply for a partner visa. You can apply for a partner visa before marriage as a de facto relationship if your relationship which longer than 12 months and you meet the eligibility for the partner visa.
